Terms of Service

1. Acceptance of Terms

By accessing or using Minisend (“Platform”), operated at app.minisend.xyz and minisend.xyz, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.

These Terms constitute a legally binding agreement between you and Minisend. Your continued use of the Platform after any modifications to these Terms constitutes acceptance of those changes.

2. Eligibility

To use Minisend, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Reside in a supported country (currently Kenya, Nigeria, or Ghana)
• Have the legal capacity to enter into a binding agreement
• Not be subject to any sanctions or restrictions that would prohibit your use of our services

We reserve the right to refuse service to anyone and may require additional verification to comply with applicable regulations.

3. Our Services

Minisend is a cross-chain stablecoin settlement layer that enables users to deposit USDC or USDT from supported blockchain networks (Base, Lisk, Polygon, and Celo) and convert them to local currency. Settlements are delivered to M-Pesa wallets or bank accounts in supported regions.

We do not provide custody, investment, or lending services. Minisend is a conversion and settlement platform only. We are not a bank, money transmitter, or broker-dealer, and do not hold user funds beyond the time required to process a conversion.

4. Accounts & Wallets

Each user receives a unique deposit address that works across all supported chains. You are responsible for:

• Maintaining the security of your wallet and any credentials used to access the Platform
• All activity that occurs through your account
• Ensuring you send only supported tokens (USDC, USDT) on supported chains
• Verifying your payout details (M-Pesa number, bank account) are accurate

5. Transactions & Fees

Conversion rates are determined at the time of transaction and may fluctuate. All applicable fees are displayed before you confirm a transaction. Transactions on Base are gasless — you pay zero gas fees for conversions on the Base chain.

Settlement times vary by payout method: M-Pesa settlements in Kenya typically complete within ~10 seconds; bank transfers in Nigeria and Ghana generally complete within 5–30 minutes. These are estimates and not guaranteed.

Once a transaction is confirmed on-chain and processed by Minisend, it is final and cannot be reversed. You are responsible for reviewing all transaction details before confirming.

6. Prohibited Uses

You may not use Minisend to:

• Engage in money laundering, terrorist financing, or any other illegal activity
• Circumvent sanctions or export controls
• Conduct fraudulent transactions or misrepresent your identity
• Interfere with, disrupt, or attempt to exploit the Platform’s infrastructure
• Use automated scripts, bots, or other tools to interact with the Platform without authorization
• Facilitate transactions on behalf of sanctioned individuals or entities

Violation of these prohibitions may result in immediate suspension or termination of your access, and we may report suspicious activity to relevant authorities.

7. Intellectual Property

All content, branding, code, designs, and materials on the Platform are owned by Minisend or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our written consent.

The Minisend name, logo, and associated brand assets are trademarks of Minisend. You may not use them without prior authorization.

8. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee uninterrupted access, error-free operation, or that the Platform will meet your specific requirements.

Cryptocurrency and stablecoin transactions carry inherent risks, including but not limited to price volatility, network congestion, smart contract vulnerabilities, and regulatory changes. You acknowledge and accept these risks by using the Platform.

9. Limitation of Liability

To the maximum extent permitted by law, Minisend and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total liability for any claim related to the Platform shall not exceed the total fees paid by you to Minisend in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, including for violation of these Terms. You may stop using the Platform at any time.

Upon termination, any pending transactions will be processed where possible. Provisions that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Governing Law) will remain in effect.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or relating to these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration under the rules of the Nairobi Centre for International Arbitration.

12. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will update the “Effective” date at the top of this page and may notify you through the Platform. Your continued use of Minisend after changes are posted constitutes your acceptance of the revised Terms.
